These Terms of Service ("Terms") govern your use of simaxepoxy.com (the "Site") and your communications with Simax Epoxy Solutions ("Simax," "we," "us," or "our"), an epoxy flooring company serving the Metro Detroit, Michigan area from Shelby Township, Michigan. By using the Site, contacting us, or requesting an estimate, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our Services

Simax Epoxy Solutions provides epoxy floor coating services for residential and commercial properties, including full flake, partial flake, decorative metallic, and outdoor concrete coating systems. Information on the Site is provided for general purposes only and does not constitute a binding offer. All work is performed under the terms of a written estimate or service agreement provided to you before your project begins.

2. Estimates & Quotes

• Estimates are free and provided based on the information you share and, where applicable, an on-site evaluation.
• Quoted pricing may change if site conditions differ materially from what was described or observed (for example, hidden concrete damage, moisture issues, or additional square footage).
• Estimates are valid for the period stated on the estimate itself; if no period is stated, they are valid for 30 days.

3. Scheduling, Site Access & Preparation

• You agree to provide reasonable access to the work area on the scheduled dates and to remove personal items and vehicles from the space unless we agree otherwise in writing.
• Weather, humidity, and concrete moisture conditions can affect installation and cure times; we may reschedule when conditions would compromise the quality of the finished floor.
• Cure times will be communicated at installation. You are responsible for keeping traffic off the floor during the cure period; damage caused by premature use is not covered.

4. Payment

Payment terms, including any deposit, progress payments, and final balance, are set out in your written estimate or service agreement. Unless otherwise agreed in writing, the final balance is due upon completion of the work. Past-due amounts may be subject to late fees and collection costs to the extent permitted by Michigan law.

5. Warranty

Warranty coverage varies by coating system and is stated in your written estimate or service agreement. Warranties cover defects in materials and workmanship under normal use; they do not cover damage caused by concrete movement or settling, moisture intrusion from below the slab, misuse, neglect, alterations by others, or failure to follow care instructions. You agree not to misuse the Site, including by attempting to interfere with its operation, submitting false or misleading information, scraping content, or using the Site or our chat widget for spam, unlawful activity, or harassment.

8. Intellectual Property

The Site and its content — including text, graphics, logos, and photos of our work — are owned by Simax Epoxy Solutions or used with permission, and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content for commercial purposes without our prior written consent. With your permission, we may photograph completed projects for our portfolio and marketing.

The Site is provided "as is" and "as available" without warranties of any kind, express or implied, regarding the Site itself, including uninterrupted availability or error-free operation. Color, texture, and finish representations on screens are approximations; actual floor appearance may vary based on lighting, substrate, and application conditions. Nothing in this section limits the written workmanship warranty provided with your service agreement.

10. Limitation of Liability

To the fullest extent permitted by law, Simax Epoxy Solutions will not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Site or our services. Our total liability for any claim relating to services performed will not exceed the amount you paid us for the specific project giving rise to the claim. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Simax Epoxy Solutions and its owners, employees, and contractors from claims arising out of your violation of these Terms or your misuse of the Site.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising under these Terms or relating to our services will be resolved in the state or federal courts located in Macomb County, Michigan, unless your written service agreement provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
